Terms of use Fleet-Go

1. General Provisions
1.1. These Terms (hereinafter referred to as the "Terms") constitute an offer by FLEET-GO, LLC (hereinafter referred to as the "Fleet-Go") to an Internet user (hereinafter referred to as the "User") to use the Fleet-Go service (also referred to as the Fleet-Go Service) ( hereinafter - "Service").
1.2. The User's use of the Service is governed by these Terms, as well as the documents of FLEET-GO, LLC:
1.3. Starting to use the Service/its individual functions, the User is considered to have accepted these Terms, as well as the terms of the Regulatory Documents, completely, without any reservations or exceptions. If the User does not agree with any of the provisions of the Terms and/or Regulations, the User is not entitled to use the Service.
1.4. Fleet-Go has the right to change the provisions of these Terms at any time without notifying the User, and has the right to change the terms of the Regulatory Documents at any time without notifying the User. The current version of these Terms is posted at: https://fleet-go.com/termofuse. The risk of not getting acquainted with the new version of the Terms and Regulations is borne by the User, continued use of the Service after changing the Terms or Regulations is considered acceptance of their new version.
1.5. In the case Fleet-Go has made any changes to these Terms, in the manner provided for in clause 1.4. of these Terms, with which the User does not agree, he is obliged to stop using the Service.
1.6. The Service offers the User the opportunity to post information about the User’s potential demand for car pick up / delivery services, as well as the opportunity to get acquainted with information about the offers of companies and self-employed providing services in this area (hereinafter referred to as the “Service Partners” or “Driver”) and search for such offers according to the conditions specified in the request by the User. All currently existing functions of the Service, as well as any development of them and / or addition of new ones, are subject to these Terms.
1.7. Depending on the User's region, all or some of the functions of the Service may be unavailable or limited. Functions are considered unavailable (limited) for a User from a certain region, if such User cannot use them explicitly. The use of any technical and software methods to circumvent these restrictions is prohibited.
The provisions of these Terms governing the functions of the Service that are unavailable (limited) to the User shall not apply until such functions become available to the User in an explicit form. Information about the availability of the Service functions in a certain region is provided to the User upon his request sent to Fleet-Go.
Depending on the User's region, if the User does not have access to the Internet, he may contact the Fleet-Go support service for assistance in using the Service. In this case, the Fleet-Go support specialist acts as the user and on behalf of the User, the rights and obligations under these Terms arise directly from the User. Fleet-Go informs about the availability of such an opportunity on the Service website https://www.fleet-go.com indicating the corresponding support phone number. Fleet-Go Help Desk in these Terms refers to both Fleet-Go's internal service and professionals, as well as persons contracted by Fleet-Go for Fleet-Go Help Desk purposes. All conversations of the User with Fleet-Go support specialists, as well as with Driver may be recorded for the quality control and service improvement purposes.
1.8. By using the Service, the User agrees to receive advertising messages. The User has the right to refuse to receive advertising messages by using the corresponding functionality of the Service or by following the instructions specified in the received advertising message.
1.9. Fleet-Go and/or involved third parties have the right to collect opinions and feedback from Users on various issues of the Service for statistical purposes, to control the quality of the services provided, and also use the received data in depersonalized form for the operation of the Service. A survey of Users can be conducted by sending an informational message or communicating using the contact information specified by the User in the account (via phone calls or e-mails).
1.10. Depending on the state, additional insurance of the transported vehicle is valid during the pick up or delivery vehicle. You can learn more about additional insurance by requesting the necessary information from the Service support service.
1.11. Fleet-Go may temporarily or permanently restrict the provision of the Service to the User without explanation, including in case of violation by the User of these Terms, orders of the government or court, causing damage to Fleet-Go or third parties (as well as to prevent such actions), putting other's into danger, protecting the rights and legitimate interests of Fleet-Go and third parties, receiving repeated complaints about the actions of the User or persons about whom the User posts information through the Service about the potential demand for car pick up or delivery services.
2. Use of the Service. The functions of the Service
2.1. The Service is provided to the User for personal non-commercial use.
2.2. Information about the services for the pick up / delivery of cars (hereinafter referred to as the "Information"), provided by the Driver(s).
2.3. Fleet-Go is not responsible for the content and/or relevance of the information provided by the Driver(s), including information about the current availability of the Driver(s).
2.4. The User may have access to the functions of rating the services of the Drivers, as well as posting comments / reviews about the Service and / or of the Drivers. Ratings and reviews of Users are posted on the Service website, and may also be available on third-party websites. When using these functions, the User undertakes to comply with the requirements for the User's content, provided for in sections 4, 5 of the User Agreement for the services of FLEET-GO, LLC, located at: https://fleet-go.com/rules.
2.5. Fleet-Go reserves the right, at its sole discretion, to restrict the User's access to the Service (or to certain functions of the Service, if technologically possible) using his account or completely block the User's account in case of repeated violation of these Terms, or use other ways to compliance with the requirements of the law or the rights and legitimate interests of third parties.
2.6. During periods of increased demand for car pick up & delivery (including pre-holiday days, days of public events and in other cases), tariffs may be increased ("Hot Hours"). Fleet-Go informs about the increase in tariffs by posting a notice on the Service website http://fleet-go.com or by other means at the discretion of Fleet-Go, including sending an text message to the User's phone number.
2.7. Fleet-Go may charge a cancellation fee for the User's, if such cancellation/ change occurred after the Driver accepted the request and less than 2 hours before pick up/delivery time. The amount of such a cancellation fee is calculated similarly to the cost of the service at the rate specified in the information provided to the User in relation to the service ordered by the User for pick up or delivering the car, or similarly to the minimum cost of the Service price.
The User make cancellation/change through account on the Service.
The User who has not provided or received the car specified in the request to the Driver within 15 (fifteen) minutes is considered to have cancel the service.
2.8. The User gives Fleet-Go consent to the processing of personal information (including personal data) of the User or person, the Person posts the information about through the Service, information about the potential demand for pick up/delivery services, or a person whose information the User has indicated in accordance with section 5 of these Terms or indicated as a contact person (recipient) when booking the pick up/delivery service, to the transfer of such personal information by Fleet-Go to companies that are part of the same group of persons with Fleet-Go , Driver, as well as the processing of such personal information by companies that are part of the same group of persons as Fleet-Go, Drivers, for the purpose of providing the User or the person specified by the User with the Service. When the User uses the Service, the specified personal information is transferred to FLEET-GO, LLC, for processing on the terms and for the purposes specified in the Policy regarding the processing of personal data of FLEET-GO, LLC, available for review at: https:// fleet-go.com/policy.
The User agrees that some personal information may also be transferred to or received from telecom companies providing services to Fleet-Go or the User, to the extent justified by the purposes of exercising the rights and legitimate interests of Fleet-Go and companies belonging to the same group of persons with Fleet- Go, including the formation of individual offers to the User within the Service.The User guarantees that he is authorized to provide personal information about the person, he posts the information about to inform about the potential demand for car pick up / delivery services for the purposes specified in this paragraph, and the person whose information the User has indicated in accordance with section 5 of these Terms.The User understands and agrees that in the case when the User is a member of a joint account in accordance with section 5 of these Terms and performs the pick up / delivery of the car as a result of posting information about its potential demand through the Service using the Fleet-Go app or website, then information about such pick up/delivery becomes also available to the person who created such a joint account.
2.9.For the time of the execution of the request for the pick up/delivery of the car between the User and the Driver, a Short-term rental agreement for a vehicle without a crew is concluded on the terms “Without payment for rent”, on the terms of the Agreement for the Short-term Rental of a vehicle without a crew.
The User confirms, when posting information about the potential demand for such a service when handing over the car to the Driver, that User has the originals of the following documents: (1) a driver's license or other identification document; (2) registration card of the vehicle; (3) insurance of the vehicle.
The car is in a completely working condition, with working lamps of lighting (headlight, taillight, turn signal), a working brake, running system, engine and transmission, a battery with a charge level that allows the engine to be started multiple times according to the current weather conditions, with tires installed on the car that have a factory-recommended manufacturer's pressure.The User undertakes to present the documents listed above to the Driver before the Driver begins to provide services.
The User is aware and confirms that in case of refusal to present the above documents, a Driver reveals a malfunction of the car or non-compliance of the technical condition of the car with the requirements specified in these Terms, as well as in other cases established by law, the Driver has the right to refuse to provide the pick up or delivery of cars and equates these actions as the User's refusal to perform the service.In the case of transfer by the User to the Driver of the Vehicle in the absence/invalidity of the documents listed above, the User undertakes to indemnify all losses associated with the absence of such documents, including fines imposed on the driver during the provision of the service.
2.10. If the Driver provides services for pick up or delivering the car to the address of the person specified by the User in the booking, this person is recognized as the representative of the User and bears the rights and obligations provided for by these Terms of Use of the Fleet-Go Service and the legislation of the United States.
2.11. The waiting time for the Driver indicated in the booking is approximate. Unless otherwise agreed by the User and the Driver, the actual arrival of the Driver at the place of pick up / drop off of the car within 15 minutes from the moment of arrival indicated in the information provided to the User from the Driver in relation to the service ordered by the User for pick up or delivering the car, is not a violation of the Term for the provision of services by the Driver.
2.12. The User undertakes not to transfer for pick up or delivery cars with the following items in them:
  • drugs, psychotropic, potent, toxic, radioactive, explosive, poisonous, caustic, flammable and other dangerous substances, including those under pressure;
  • firearms, pneumatic, gas or edged weapons and their parts, ammunition, fireworks, flares and cartridges;
  • moneys;
  • precious metals, precious stones and products containing them;
  • items and substances that, by their nature or due to packaging, may pose a danger to people, pollute or spoil (damage) other goods, surrounding people or objects;
  • animals and plants, biological materials;
  • items requiring specially equipped vehicles for transportation, including foodstuffs;
  • liquids in open containers;
  • fragile items without special packaging;
  • any other items, the circulation of which is prohibited or restricted in the territory of the United States.
Fleet-Go may impose other restrictions on items in a vehicle for pick up or delivery.
The User is aware and confirms that in case of non-compliance with the above requirements, User is solely responsible for all the negative consequences that may occur in the process of providing services by the Driver. At the same time, the Driver(s) has the right to refuse the User to provide the service if the Driver(s) detect items that are not subject to transfer and / or to the pick up or delivery of cars.
3. Online/mobile payment function
3.1. Payment for the service of pick up or delivering cars of the Driver(s), provided to the User in accordance with the information posted by him using the Service about the potential demand for the corresponding service, can be made in the following way:
3.1.1. The User have access to the function of online or mobile payment (3.2. of these Terms); in this case, Fleet-Go acts on behalf of the Driver(s) with the involvement of an authorized operator for receiving payments, or participants in settlements and is the payee as an agent of the Driver(s) (hereinafter referred to as “Online payment “).Fleet-Go does not guarantee that the Service will not have any errors and failures in relation to the provision of online payment.
Online payment, at the discretion of Fleet-Go, it is possible to conduct both one transaction for the full cost of the service, and several transactions for separate parts of the cost of the service. At the same time, online payment can be made by any of the specified methods before the provision of the service, during the provision of the service, or upon its completion.In case of non-cash payment, along with payment for the service, the User has the opportunity, at his own discretion, to also make an additional payment in favor of the Driver(s) as a percentage of the cost of the paid service (hereinafter referred to in these Terms and in the interface of the Service - "Tipping" ).
3.2 Fleet-Go does not have access to the credit card data specified by the User and is not responsible for the safety and confidentiality of the transmitted data when making a online payment. Online payment is carried out by the User with the participation of an authorized operator for receiving payments, or other participants in settlements, and is regulated by the rules of international payment systems, banks (including the issuing bank) and other participants in settlements.
3.3. The User understands and agrees that all actions performed within the Service using the mobile phone number confirmed by User, including online payment, are considered to be performed by the User.
3.4. If the User disagrees with the fact and/or amount of payment, the User has the right to contact Fleet-Go through the support (feedback) service interface within 14 days from the date of payment or other actions or events that caused the appeal.
If, based on the results of the verification on such an appeal, Fleet-Go decides to refund the amount of the payment completely or to refund a part of it, the specified refund is made to the bank account of the bank card from which the payment was made. The procedure for the return of funds is carried out with the participation of an authorized operator for accepting payments or other participants in settlements and is regulated by the rules of international payment systems, banks (including the issuing bank) and other participants in settlements.
3.5. Fleet-Go reserves the right at any time to require the User to confirm the data specified by him within the Service, including the data of the credit Card, and to request in this regard supporting documents (in particular, identity documents), failure to provide which, at the discretion of Fleet-Go, may be equated with the provision of false information and entail the consequences provided for in clause 2.5 of these Terms
4. Function “Pick Up / Delivery of corporate vehicles"
4.1. If person who has entered into a separate agreement with Fleet-Go for the provision of the “Pick Up / Delivery of corporate vehicles” service has indicated the User’s phone number in his personal account provided by Fleet-Go on the basis of such a separate agreement, as a corporate user, the use of the Service is carried out by such person in favor of the User on the terms and conditions determined between the mentioned person and the User.
4.2. The use of the Service by the person specified in clause 4.1 in favor of the User can be carried out both using software tools that are not available to the User, and using explicit functions of the Service provided to all Users. In the latter case, the User acts on behalf of the person specified in clause 4.1, and the rights and obligations under these Terms arise directly from such person, including the obligation to pay for the car pick up/delivery service.
4.3. The User understands and agrees that his use of the Service in the manner provided for in this section 4 will not be considered the use of the Service for the personal purposes of the User.
5. "Joint account" function
5.1. The user may have access to the function of creating a joint account in the Fleet-Go program for mobile devices, which means the possibility of using the Service by several Users within the framework of one created account, as well as the payment for services for the pick up / delivery by participants in a joint account by online payment from the credit card of the User who created the joint account.
5.2. To create a joint account, the User must provide the following information:
  • User's phone number;
  • E-mail address;
  • Phone numbers of third parties who will be members of the joint account;

The user can specify other data if necessary.
5.3. As part of the "Joint Account" function, the User is given the opportunity to create a business account.
5.5. Within a business account, the number of participants cannot exceed 10 (ten) Users. The user may be offered additional functions and services for a fee.
5.6. In order to use the "Joint Account" function, account participants whose mobile phone numbers have been specified by the User in accordance with clause 5.2 of these Terms must install the Fleet-Go program on their mobile device.
5.7. When a member of a joint account posts information about the potential demand for car moving / delivery services, the member must indicate in the interface of the Service that the use of the Service is carried out using the "Joint Account" function.
5.8. The User undertakes to familiarize the participants of the joint account with the terms of use of the "Joint Account" function, to obtain the consent of the participants to receive technical and other messages necessary for the use of the "Joint Account" function.
